"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied benefits of, or be subjected to discrimination under any educational program or activity receiving Federal financial assistance." - The Education Amendment of 1972 (Title IX, 20 U.S.C. Sec. 1681, et seq.)
Sexual misconduct is prohibited by Title IX. Sexual misconduct includes sexual assault, sexual harassment, intimate partner violence and stalking. Any non-consensual contact of a sexual nature may be deemed sexual misconduct as well.
Sexual misconduct may also include sexual activity, sexual discrimination, unwelcome sexual contact, coerced sexual intercourse, sexual exploitation and retaliation against any person that has reported a situation to officials.
The university’s sexual misconduct policy states that the “policy applies to all Longwood students, staff and faculty in all university programs and activities regardless of location of the incident(s).....All Longwood students, staff and faculty shall be offered immediate resources which may include counseling, medical assistance and living, learning and/or appropriate working environment accommodations.”
All situations which violate the sexual misconduct policy should be reported immediately and are granted maximum possible privacy by officials. Complainants are encouraged to report to the university Title IX coordinator and Longwood Police.
Once a report of sexual misconduct is received, the university will conduct an impartial investigation into the matter. Complainants (reporters) and respondents (those reported against) will be separated should they work or reside in the same area of employment or residence. If appropriate, prevention of contact between individuals will be placed in the situation.
Anyone who believes they have been a victim of sexual misconduct may report the situation to the Title IX coordinator and Longwood Police. Complainants may also make a limited report with a trained campus advocate or make a confidential report with staff members of the Counseling Center, Student Health & Wellness Center, or any off-campus crisis resources. The campus staff in both centers are available for assistance free of charge.
All cases of sexual misconduct that are reported through the Title IX coordinator will be kept confidential and the complainant may request that his or her name be kept confidential from the respondent.
Sanctions, remedies, and corrective actions include: a requirement not to repeat or continue the conduct, reprimand, reassignment, suspension, termination of employment and expulsion.
